1. Our Services

PingMyCar is an anonymous vehicle contact platform that gives every car a unique Vehicle ID sticker. Anyone can contact a vehicle owner instantly by texting the Vehicle ID to our Australian number or visiting the vehicle's unique web page — without sharing personal phone numbers on either side. The platform routes all communications anonymously through our system.

PingMyCar offers three plans:

• Basic — $17.95 one-time payment
• Connect — $24.95 one-time + $4.95/month subscription
• Premium — $39.95 one-time + $4.95/month subscription

2. Intellectual Property Rights

We are the owner of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics. You are granted a limited licence to access and use the Services for your personal or internal business purposes only.

3. User Representations

By using the Services, you represent and warrant that:

• You are at least 18 years of age
• You have the legal capacity to agree to these Terms
• You will not access the Services through automated or non-human means
• You will not use the Services for any illegal or unauthorised purpose
• Your use of the Services will not violate any applicable law or regulation

4. Prohibited Activities

You may not access or use the Services for any purpose other than that for which we make them available. Prohibited activities include:

• Use the Services to advertise or offer to sell goods and services
• Sell or otherwise transfer your profile or Vehicle ID to another person
• Harass, threaten, or abuse other users or vehicle owners through the platform
• Attempt to identify or reveal the personal information of any vehicle owner or scanner
• Use the platform for any fraudulent or deceptive purpose
• Interfere with or disrupt the integrity or performance of the Services
• Attempt to gain unauthorised access to any part of the Services
• Use the Services in any manner that could disable, overburden, or impair the Services

5. Services Management

We reserve the right to monitor the Services for violations of these Legal Terms and to take appropriate legal action against anyone who violates them. We reserve the right to restrict or deny access to the Services to anyone for any reason or no reason at our sole discretion.

6. Subscriptions

Connect and Premium plans include a monthly subscription of $4.95 AUD that automatically renews each month. You can cancel your subscription at any time by logging into your account dashboard or by contacting us at hello@pingmycar.com.au.

We accept Visa, Mastercard, and American Express payments processed securely through Stripe. All payments are in Australian dollars (AUD).

Refund Policy: Due to the nature of our physical product — stickers printed specifically with your unique Vehicle ID — we do not offer refunds once your sticker has been produced and dispatched.

7. SMS Communications

By registering with PingMyCar, you consent to receive SMS messages from us including vehicle contact alerts, account notifications, and service updates under the PingMyCar text messaging program. Message frequency varies based on vehicle contact activity.

8. Term and Termination

These Legal Terms shall remain in full force and effect while you use the Services. We reserve the right to deny access to and use of the Services to any person for any reason at our sole discretion without notice or liability. If we terminate or suspend your account, you are prohibited from registering a new account.

9. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time or for any reason at our sole discretion without notice. We cannot guarantee the Services will be available at all times. We will not be liable for any loss, damage, or inconvenience caused by your inability to access or use the Services during any downtime or discontinuance.

10. Governing Law

These Legal Terms are governed by and interpreted following the laws of Australia. Any disputes will be subject to the exclusive jurisdiction of the courts located in Melbourne, Victoria, Australia.

11. Dispute Resolution

To expedite resolution and control the cost of any dispute, the parties agree to first attempt to negotiate any dispute informally for at least 30 days before initiating arbitration. Informal negotiations commence upon written notice from one party to the other.

If informal negotiations are unsuccessful, disputes shall be resolved by binding arbitration in Melbourne, Victoria, Australia, conducted in English by a single arbitrator.

12. Limitation of Liability

In no event shall PingMyCar be liable to you for any amount greater than the amount you have paid to PingMyCar in the preceding 12 months. PingMyCar shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.

PingMyCar is a communication relay platform. We are not responsible for the actions, conduct, or outcomes resulting from communications between scanners and vehicle owners facilitated through our platform.

13. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time without prior notice.
